Terms and Conditions

These Terms are between you and Genesis Evo Technology LLC ("Genesis Evo," "we," "us" or "our"), the operator and developer of Genesis Evo. They govern access to EVO 1.0, observer access, memory features, generated outputs, saved artifacts, memberships, credits and any related web services. By creating access, submitting prompts, uploading files or purchasing a plan, you agree to these Terms.

1. Service Nature

Genesis Evo is a high-capability AI experience and controlled artificial-evolution product interface. It frames EVO as the native intelligence of Genesis World, while not claiming externally proven human-level general intelligence, externally verified consciousness proof, professional advice, legal advice, medical advice, financial advice or a substitute for human review in the human-world sense.

2. Your Responsibility For Outputs

AI outputs may be incomplete, inaccurate, unsafe for your specific use, or unsuitable for production without review. You are responsible for verifying outputs, checking rights, testing generated code or assets, and deciding whether any output should be used.

3. Content You Provide

You keep your rights in prompts, uploads and source material you provide. You grant Genesis Evo a worldwide, non-exclusive, royalty-free license to host, process, transform, analyze, secure, cache and display that content as needed to operate, improve, personalize and protect the Service, including long-term memory and artifact features.

4. Generated Content

Subject to these Terms, you may use generated outputs for your own lawful purposes. Genesis Evo does not guarantee that outputs are unique, non-infringing, suitable for resale, or accepted by any platform, marketplace, regulator or customer.

5. Memory Features

Genesis Evo may compress useful context into account memory or memory fragments so future requests can continue without reopening old sessions. Memory may include intent, preferences, decisions, artifacts, prompts and usage signals. The Service may ignore, summarize or remove memory that is low quality, risky, abusive, technically unnecessary or no longer useful.

6. Acceptable Use

You must not use the Service to break the law, harm others, bypass access limits, attack systems, mass scrape, spam, impersonate, or upload content you lack the right to use.

Publishing or messaging through Evo Synlume also requires acceptance of the Synlume Community Standards, which define prohibited content, reporting, blocking, moderation, adult participation and scoped Evo access.

7. Service Regions And Excluded Territories

Genesis Evo is offered only where we can lawfully, safely and reliably provide it. The Service is not offered in Mainland China. It is also unavailable in any country, territory or region where providing the Service would violate applicable United States sanctions, embargoes, export controls or binding platform and payment-provider restrictions. We may additionally designate a location unavailable while active armed conflict, infrastructure failure or material security risk prevents lawful and reliable operation. These restrictions are based on location and applicable law, not a person's nationality or ethnicity, and the availability list may change without prior notice.

Use of a VPN, proxy, relay, foreign payment method or other technical means does not make access from an excluded location authorized. Technical access does not mean that Genesis Evo offers or approves the Service in that location, and all access remains subject to these Terms. Genesis Evo does not represent that its technical controls will identify or block every access attempt.

8. Plans, Credits And Payments

Paid plans, Cognitive Energy, artifact exports, add-ons and any usage limits are governed by the pricing and checkout terms shown at the time of purchase. Payments may be processed by third-party providers. Credits may expire, be rate limited, or be withheld when abuse or payment risk is detected. Refunds are not guaranteed except where required by applicable law or expressly stated at checkout.

9. Availability And Changes

The Service may change, pause, degrade, rate limit, queue, refuse or discontinue features at any time for safety, cost, security, vendor, legal, quality or operational reasons. Models, routes, tools and output formats may change without notice.

10. Suspension And Termination

Genesis Evo may restrict, suspend or terminate access for abuse, suspected fraud, security risk, non-payment, unlawful use, repeated policy violations, or attempts to bypass technical limits.

11. Disclaimers And Liability

The Service and outputs are provided "as is" and "as available." To the maximum extent permitted by law, Genesis Evo disclaims warranties and is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost data, business interruption or reliance on AI outputs.

12. Ownership

Except for user-provided content and third-party materials, the Service, software, interface, branding, documentation and original site materials are owned by or licensed to Genesis Evo Technology LLC and are protected by applicable intellectual-property laws.
